Custodial Tug-of-War
The heated
debate over the Subic rape issue did not end with Judge Benjamin Pozon’s
Dec. 4 verdict convicting L/Cpl. Daniel Smith and acquitting his three
co-accused. The battle now between the U.S. and the Philippines is for the
custody of Smith – in which the Philippines turns out to be at the losing
end. Under the Visiting Forces Agreement (VFA), if the U.S. demands
custody of its military personnel accused of or found guilty of criminal
acts, the Philippines has no choice but to give in.
Salungguhit literally means to
underline; figuratively, to
underscore or highlight.
