ABS-CBN Dismisses Workers Who Refused Downgraded Contracts

In the said case, the petitioners, all employees of the ABS-CBN Cebu, claimed they had rendered more than a year of service to the company and, therefore, should have been recognized as regular employees entitled to security of tenure and to the privileges and benefits enjoyed by regular employees. However, ABS-CBN Cebu allegedly considered them only as talents and not as regular employees.

“The bad faith in ABS-CBN’s move toward its illegitimate goal was not even hidden; it dismissed the petitioners – already recognized as regular employees – for refusing to sign up with its service contractor. Thus, from every perspective, the petitioners were illegally dismissed,” the Supreme Court said in its decision dated January 21.

Kapamilya

“The management does not consider us as kapamilya, not even children out of wedlock,” Perez said.

Galima said they have been treated like criminals. “Our pictures are posted at the gates,” he said, adding that they were denied access to the network’s compound and could not even talk to the HR to ask about the status of their employment.

On the day of Lopez’s deadline, Galima said, they could not find their names on the schedule of programs and on the list of those who would be on a day-off. “Until now, we got no answers,” he said.

Most of the 25 dismissed workers are breadwinners and have children. “Some of us are really devastated,” Perez said.

“My children do not know yet that I am now jobless,” Johnny said tearfully. “I have not told them because I do not want them to get discouraged from pursuing their studies,” he said. Johnny has four children, three of whom are in college.

Co-employees who expressed support to the dismissed workers have been wearing arm bands but are also being threatened of losing their jobs, Perez said.

Precedent

Perez also expressed fear that their case could set a dangerous precedent to the media industry.

“This is an attack against media workers in general,” Perez said, adding that even rank-and-file employees can become contractual. “Other networks can follow suit,” he said. He said further that when it comes to the welfare of workers, rival networks are silent.

Appeal to Noynoy

Perez said they would try to seek the help of incoming President Benigno “Noynoy” Aquino III.

“He said he wants more jobs for Filipinos, we hope we are included in those who will still have jobs. We hope we would not be added to the statistics of the unemployed,” he said.

“He said he is against corruption. We hope we would not be victims of corruption in relation to the cases we filed before DOLE,” the union leader said.

As for Johnny, he said, a good company should also maintain good standards for the interest of its workers. (Bulatlat.com)

  2. dati ako empleyado sa abs-cbn(ijm engineering crew).since 2000-2008 ako nag work dyan.grabe trato sa amin para kami alipin,pag marami taping bawal ka mag day-off,kahit day-off ka tatawagan ka ng bisor mo,pag hindi ka pumasok mumurahin ka at ilan araw ka ilalagay sa day-off.ang mga boss dyan sa engineering ng abs-cbn "WALA GMRC"(GOOD MANNERS AND RIGHT CONDUCT).sa tagal ko nag work dyan nagpakahirap lang ako sa wala! pag nagka sakit ka napakahirap kumuha ng medical loan samantalang salary deduction naman.napaka buti lang ng abs-cbn sa mga ibang tao basta mapupuri sila pero sa sarili nila empleyado ginagawa nilang TIMAWA!!!

  3. this is true. i know friends that are working there.. and they are being abused.. always overtime.. hindi ka mabbigyan ng dayoff hanggat di ka nagkakasakit tapos ganyan gagawin nila..

  4. it's really sad. nag-OJT ako sa ABS-CBN kaya alam ko na talagang ganyang asal-hayop yang mga bossing ng mga yan. shark-infested waters ika nga pag napasok ka sa loob. asar nga ako sa mga tao pag sinasabi nilang kapamilya raw sila. naku kung alam lang nila kung panu itratong parang hayop ng ABIAS-CBN yung mga empleyado nila eh ewan ko lang kung maging fan pa rin sila ng channel 2. it's also sad that these things are happening to the media people at a time kung kelan ang mga journalists eh nagiging endangered specie na at isa=isa nang pinagpapapatay. deepest sympathy to the people who lose their jobs. sa mga natanggal, don't worry, in God's time, you will be having justice. whatever happens, nakasuporta lng ako sa inyo.

    yung mga taong nasa likod talga ng camera (literally and figuratively) ang tunay na bumubuo ng isang media network. mas dapat silang bigyan ng halaga at respeto.

  6. This is indeed true, i was a former ijm 'employee'. I'm just lucky enough to quit early on and to realize that our status as contractual to the network or as program-based can be very abusive. Kahit ngayon, abuso pa din sila, even HR department can't protect or even help them. Sabi nga ng ka-batch ko sa loob, may 'martial law' na sa abs.

  7. This is sickening (if indeed this is true). Imagine a media network whose leading on-cam personalities have, over then years, heralded themselves as fighters for human rights, protectors of the oppressed, the voice of the marginalized sectors and the last bastions of the poor and hopeless but law-abiding citizens, being cited for blatant disregard of its workers’ rights. Where is the Kapamilya spirit? Paging President Noynoy…. like what Hulk Hogan used to say….WHAT’S YA GONNA DO ABOUT THIS, BROTHER?
